I didn't say it was valid or might work in Nick's favour. I'm just guessing in the absence of any public facts. Like everyone else.

It's seems the only public facts are that, he refused a 2nd test and is asking to delay the hearing.

Clutching at straws?

Anyone refusing to take a drugs test should be treated like a drink driving refusal to take provide a breath sample at the road

side or taking a test at the police station and are therefore banned for the maximum time allowed when taking to court.

Ok, when did he take a test, was it on the evening in question?

So, the Brummies have a "facility" until the hearing date of 16th August. What happens after that? Assuming that his defence is no better than anyone else's defence for not complying with testing procedure, and he gets a ban off the SCB, then what?  More facilities until the end of the year?  Is there a record for the fewest number of meetings a team has ever appeared with a full complement of 7 "own" riders, in a 2-season period? Ironically one of the few wins this year was when they actually did field their own 7-man team.

Im sure i remember years ago when Smart and Lobb got caught, Smart held his hands up and admitted it and Lobb refused a second test for a while therefore got a longer ban?
