What's legal got to do with it - this is not a test which falls under the law, merely one to evidence compliance with the rules of the sport. He's admitted he had a few the night before and initially accepted the verdict so for me whether it was Joe, Fred or Mary holding the tester is irrelevant - it's the reading which is relevant.

And that my friend is why he'll get the Ban for FIM events and thus be free to ride domestically !!

That is hardly a ban! He is not in the SGPs so would effectively miss out on the SWC - wow what a big punishment - NOT!

That'll be one of the arguments he will present and if it's not being held in a court of law and they ban him from all speedway he'll most probably take it to the courts of human rights to exercise his right to work !

If a sportsperson is found to be under the influence - they get banned! If you can't do the time - don't do the crime!

 

He (or anyone else) has no right to work if banned by their affiliated organisation and absolutely nothing to do with human rights!!

If Ward has signed a contract and part of that contract is that he has to abide by FIM rules then they can ban him from riding. If the FIM also control domestic speedway they can ban him from riding in which ever domestic league they control. He can go and ride where ever the FIM do not have control.

Maciej Janowski must be very pleased after such a good season he now has to sit back and see if he is third or forth in the pecking order.

 

If they don't get Darcy for the season it may be they could look at Gracjzoneck or Milik to return and someone like Gustafsson or Korneliussen but they still have plenty of assets to look at like Bjarne Pedersen or Protasiewicz however Shamek or Magic look best options.

 

Pontus Aspgren has been mentioned and he has been looking at riding in the Elite League and turned down a chance to stay at Somerset. His average should be

I'l set the scene now, Darcy sat in his hotel room by himself drinking bottles of whatever, watching the crap they put on TV in that country, and ringing room service for another top up !!! :rofl:

And how would you feel if you were told that because of something you have done it no longer gave you the right to work for who you work for.................

 

This is all blowing up out of proportion now..............Darcy admitted he had a drink the night before for whatever reason..............he knows he was in the wrong................the FIM have messed up big time by continually delaying the hearing...............which suggests there is an error on their side................

 

Some people really want to look at the facts and accept that there could have been incorrect calibration of the equipment or the results recorded wrongly or indeed the testing procedure not carried out correctly/by a non FIM registered official instead of slagging Darcy off left right and centre...................put your own house in order before trying to pull someone elses down.................

I'm at a loss as to why certain Poole fans keep backing Ward? I'm fed up of seeing page after page of excuse after excuse to try and get him off looking for any loophole to do so. I don't want to see him out for a long time but the wrong message is being sent out. I applaud the true Poole fans who feel he has let the club down and feel he should serve his punishment and move on. While people like Middlo are almost applauding what he did and Ford unbelievably stating Darcy won them the league, then I'm afraid he will never learn he will just think he can get away with anything. Just imagine how good Ward could be with the attitude of a Woffinden or Pedersen. Darcy Ward should be allowed to ride again in the next few months but if he is allowed to start the season i will be stunned. Do what you like get in some fancy lawyers and try to get away with it

Yes I would be saying it for whoever digressed - he's not guilty (or innocent) because he rides for a particular club and it is foolish to suggest that is the case!

 

Don't see how you an deduce that the FIM messed up big time by continually delaying the hearing - it suggests nothing more than a delay and anything else is speculation.

 

Your last paragraph was funny though - look at the facts! The facts are that he failed a test and is suspended pending his hearing - anything else is pure speculation! I don't believe I have been slagging Darcy off as I think he is the most talented rider on a speedway bike - I guess it must be the Poole spin - someone says something about a rider who happens to ride for Poole therefore they are Poole haters/bashers.

 

And to your final point - I haven't failed a breath test so nothing to put in order whereas Darcy has! like many people on here, I don't like the finding and using of loopholes and it seems that despite failing the test, Darcy (and his team) are now proposing that the test was flawed. That's not anti-Darcy or anti-Poole! :mad::rolleyes:

The answer to your question is yes but why does it matter if it was only he that consumed too much alcohol?

Dumb comment. The FIM are not a contracting state to the European Court of Human Rights so Ward can't take his case there.

What is it with some Poole supporters that makes them spout this rubbish. Never read such crap in my life as the comment above.

 

When the FIM suspended Darcy, they waited a week after the offence to access the evidence before implementing a verdict. Had there been any doubt, Darcy would've escaped. As it is he was found to exceed the limits allowed and was punished. All we are hearing now is posters trying to justify Darcy innocence.

 

For the sake of the sport, Darcy has to get at least a years ban. and hope he will learn from it. Anything less will turn the Sport into a mockery.

 

As for that crap about 'Human Rights and able to work' By taking away Darcy's licence, the FIM haven't took away his right to work, just stopped him riding a bike. I sure if Darcy wanted to work on a Building site or in a factory, the FIM wouldn't object.......

 

Darcy will be riding for Poole this year you'll see

Sorry, but Darcy informed us that he had one drink tea time and then went back to the hotel upset before going to bed. Are you now telling us another GP rider went to bed with Darcy? As that could be a pretty big scoop.

 

Unless Darcy was lying. But he wouldn't do that would he?

What difference does it make if Darcy was drinking alone or with another GP rider?

 

If there was another rider with him, and that rider wasn't over the alcohol limit the next day, then the other rider will have done nothing wrong.

The alcohol test is done on a random basis and all riders are not tested. As far as I am aware 2 riders are picked.

Let me make this clear I am NOT defending Darcy at all, anyone that goes out drinking a night before a GP and when you could still be world champion is asking for trouble. The FIM need to look at their tests and they should be done on all riders prior to any GP.
