Not really. If there's a technical problem then you can't definitively prove that a person was guilty given no other evidence.

 

Yes, sporting cases are decided on 'balance of probabilities' rather than 'beyond reasonable doubt', but Darcy Ward was clearly not steaming drunk at the GP, and was likely well below what's considered an acceptable limit for driving. That's obviously not a defence if the acceptable limit for riding speedway is zero, but if the testing procedure was faulty or not carried out properly, then it is possible that an erroneous reading was taken.

 

Agreed. If there is reasonable doubt that the readings were correct (or even if the procedures were correctly followed) then he should be found not guilty (not the terminology for this case mind)..

 

Whilst nobody should be wrongly found guilty, innocence on a technicality is a different matter. There is quite a difference between a faulty measurement and the tester entering the wrong date on the documentation for example. You would hope the objections relate to reasonable doubt he was over limit as opposed to a (non impacting) administrative error.

 

But my point was about finding a loophole. If he was indisputably over the limit, but the objection was a minor documentation issue, then, in my opinion, that's a very different matter.

Look like most people say Darcy Ward is not worth debating, the majority? say we're better off without him! We'll just have to spend 126 pages discussing someone else. Whats Nicki been up to? :-)

Nicki went back to his primary local school in Brenderup yesterday, in conjunction with the local police, and talked to the kids about road safety. bless him, even giving out hi vis vests to the kids....He wore his kevlars and even put on a hi vis vest himself ;)

CONTACTED BSI to see whether they had any Ward update and reply was "not a dicky bird."

Only people of a certain age and from parts of the country say things like that now.You and Mike Patrick for instance.......

Not many Nicki fans may think of looking in the Darcy Ward thread for such info.

 

If only there was a way of creating a Nicki Pedersen thread of his own.

what does Darcy do off the track? eeer, we better not go down that road again, all a bit seedy. What does Nicki do? Well hate him or love him, he is fairly professional off the track.

KEEP your hair on ... was just curious as to whether BSI had heard something during their many conversations with the FIM. And, of course, they want to know the outcome, just as we do.

 

I apologise for my tone. I'm just sick of money making enterprises telling the sport what to do when the people that should matter, the fans, seem to be totally ignored.

According this article, Darcy have signed a new contract with his Swedish team and the team manager for that teams says that Darcy's lawyers expects Darcy to get a 6-8 month ban.

A couple of thoughts from the Swedish report ...

 

The lawyer seems to be basing his advice on the Stefan Danno case ... That was in 2000, now 14 years ago.

It will be interesting to see if a case from so long ago, when some aspects of doping control administration were quite different, really is a guiding precedent for today.

 

Stefan Danno's case was decided in the week before Christmas for an offence committed at the end of September ... So timing wise Darcy's case isn't really that delayed by comparison, yet.

 

And finally, the report makes no mention of the possibility of him being cleared on the grounds that the test was performed wrongly.

He is now expecting a ban, so must now be reconciled to guilt being established?
