To the lawyers this is quite normal behaviour. It is only 'us' on the outside, and the sort of FIM chap that would even speak to Philip Rising, who contribute to the feeling that the 'delay' is unusual. Not the lawyers. You would like to hope if he did get off on a technicality he would think himself bloody lucky and focus on getting his career back on track. But I do wonder if he is easily influenced as there are a lot of hanger oners in speedway, and just maybe he has not got the right people around him. I do not think Matt Ford is the problem after all he is a business man and who has turned Poole speedway around to a very sucessful team and no-one can take that away from him. If only Ward was back at Kings Lynn under Lyon and Chapman maybe things would have been differnt. In my opinion in an ideal world if he was at Wolverhampton under Peter Adams and CVS would be amazing. If I was Ward I would be head hunting Pete Adams to come on board in Wards camp, I think he would be the answer to all Wards problems. If only!! Hangers on, go hand in hand with all star pro's. Matt ford as business man wants to make money as possible and for him having Darcy in his team is good business. It makes the team successful which attracts crowd and sponsors. This means that Ford (and Neil M possibly) don't really want to "deal" with Darcy since that would be bad for business. As for the hearing dates, do we know if the claims from Darcy and his "camp" are correct and that FIM actually have postponed the dates several times? That it isn't something used by Darcy to get sympathy and FIM actually having set the date in late January from the beginning? As for the actual test result perhaps FIM doesn't want to reveal it until the hearing to avoid Darcy/his lawyers somehow trying to find an excuse to Darcy being over the limit? Personally I think that if there had been something wrong with the testing, it would have been discovered by the FIM's medical committee and then they would not have delegated it to the Disciplinary committee (CDI). I am not 100% sure but I think the process after a positive test is like this : Breathalyser test->report to local jury-> fines and ban from race issued-> report to FIM Medical committee->investigation of the case-> delegated to CDI if investigation finds test results accurate->CDI arranges a hearing->CDI decides on penalty after the hearing is complete. Darcy would still have to show that he was under the limit. The fact that the calibration may not have been checked prior to the test does't mean it was wrong. So Darcy's first hurdle would be to prove it was wrong at the time of the test, and that if accurate it would have shown him under the limit. Even if if he gets over the first hurdle he would still have to show that the FIM were negligent or in some way unreasonable in suspeded img him while they investigated, and that would also not be easy. There are also other potential problems depend which country court proceedings were started in. At the moment I would say that any court action is remote and at best long way off. This is a point I made earlier. In Major League Baseball a very high profile player, Ryan Braun, managed to get off a failed drugs test on a technicality., It wasn't long before MLB caught up with him though (and others). I belong to a number of local history sites on Facebook and have learnt a lot through the sharing of information on there. And there are some brilliant photographs that turn up from time to time. There were only two brits in the meeting and I understand tai doesn't drink? Were tai and bomber really both drinking heavily before that gp?
