Nick Morris is riding on Jan 3rd in a meeting to try to qualify for the 2014 Aus Championship which start on Jan 4th, where if he gets through he be in a line up with Troy and Jason. Shortly afterwards, just because of a few wayward golf shots went in the direction of these houses, the club had to make alterations to the first hole to alleviate this problem. The fact the golf course, had been there for years meant nothing, Once objections are raised then it presents a different scenario, and complaints from those houses will always take preference over any sporting exercise, regardless of who was there first. Following the court judgement regarding Mildenhall stadium (which is now the binding case law on the subject) that is no longer true. Basically, people who moved in next to the stadium were told that if they didn't like the noise, they shouldn't have bought the house. When they said they didn't know it was there, they were told they should have found out. I hope you are right, I really do. but many times I've seen the ruling go in favour of the household. I think it's more to do with the Judge than a certain ruling... The case of moving to an area which already has noise etc should be common sense, but how often is common sense ignored and the idiot who moves next to a noisy activity is able to get it resticted, ie get the noise from church bells restricted. I think the point with the Mildenhall ruling is that it is specific to speedway stadiums and people complaining about noise and nuisance who have moved in afterwards and where the stadium is long established. Its a court of appeal decision, so it will be binding (or at least very persuasive) on any future judgement where the same circumstances apply. For the layman, it also has the considerable benefit of being one that is backed by common sense - after all, if you don't like an area for whatever reason, it is not for that area to change to suit you but for you to choose somewhere else to live. Its difficult to overstate the relevance of this ruling for existing stadiums surrounded by new housing developments (Edinburgh is a good example).
