I think you will find Larsen and Fisher were signed before last week!!! try and keep up :lol: You are obviously obsessed by bad mouthing the Panthers, but at least try and keep to the facts. :icon_smile_clown:

 

A panthers fan thinking there promotion is being consistent, as expected.

 

I dont need to bad mouth the Panthers, your own assets are doing a decent enough job to escape which says all i need to know. :t:

BUT would you try and sell or rent a home that you actually didn't own?

in the eyes of the bspa who run/govern the sport in this country he is owned...riders, promoters have to follow the rules sanctioned by the the bspa don't they ???

it's fairly obvious you and paul burbidge don't like the asset system,why don't you take the bspa members to task about it

But these are the rules that ALL promoters aware of and should adhere to on all occasions and not just when it suits their own agenda's. I don't recall Kings Lynn or Speedway Star berating the asset system when Ward & Batchelor were sold for large sums of money.

You cannot own a person,you cannot stop a person working. Hans should take them to the european court. He will win without a doudt and frost would back down before it even went that far.

Always going on about the rules! So explain why Coventry were given permission to speak to Hans and Swindon weren't? The rules state that if the parent club don't plan on using a rider, the club that they were last on loan with has first refusal! A good example of NOT adhering to the rules on all occasions and just when it suits their own agendas :rolleyes:

Who is stopping him from working - he could have ridden for Coventry? He could have ridden for Peterborough? He chose not to so if he wants to ride for Swindon they have to purchase him. They obviously agree with the concept of owning riders, why else would they have bought Doyle?

Quite clearly, though, the respective purchasers/tenants believe the current owners do 'own' them, having just used the current system to add to their own property portfolios.

It is correct, that is the system.

Folks keep banging on about the word 'own' in respect of the rider. Clubs hold a rider's registration for the UK, so therefore have a role in where he rides.

It's not about whether or not you are offered a job, its about being prevented from taking a specific job due to an unfair restraint.

 

There are BSPA regulations which do slightly cloud an otherwise straightforward case, and those regulations aren't meaningless even if the asset system were proven illegal.

 

But ignoring the BSPA regulations for a moment (including issues such as potential illegal approaches) Swindon have two job vacancies. There are two riders they want to fill them. The two riders would like to take up this employment. Those two riders currently have no contract with their 'owning' club, and even if you call the asset agreement a contract this gives no benefit to the rider so is most likely not fit for purpose.

 

Swindon are not allowed to contact these riders, nor make them an offer unless Peterborough agree. Even if this agreement is given, they may only employ these riders after compensating Peterborough.

 

This is where the restraint of trade would come in, selectively preventing where an unpaid rider can seek employment.

 

A contract could include a clause preventing the employee from obtaining employment from competitors within a certain time period. But there would have to be a current contract. And you couldn't have that type of contract in speedway for obvious reasons.

Lets face it frost does not want Hans riding for them, never did and why the low offer.He wants his cake and eat it.Hans does not want to ride for them like others. He should just let them go out on loan, no big deal really.

 

your choice if you take a job or not, this is defferant by stopping a person from earning a living full stop take them to court.

 

if i were hans i would call his bluff, ride for them score 0 every meeting and then get dropped or not ride UK and frost gets nothing, loan or transfer. system is flawed, always has been, frost knew this coming into the sport. about time he left as always causing hassle.

It is clear frost wants the rules to only favour his team, now who was it banging on about fairness for all a couple of seasons ago? :rolleyes:

 

As we have come to expect from the Panthers promotion - say one thing but do another.

 

I really hope the mess that they have created gets sorted soon and the innocents in all this - the riders - can get on with trying to do their job, someything that Frost, it appears, is trying to prevent.
